 Why settle for half the story?
It is interesting how potential immigrants from various countries have different priorities when looking at the regional center program options. In working with clients from around the world it has surprised us how this can affect the regional center program that different nationalities may opt for. We remain concerned that not all potential immigrants are always given in-depth explanations concerning the range of options. This can have a major potential impact:-
For example: Some programs may seem an excellent option in terms of successfully completing the initial I-526 petition stage and the two year conditional green card approval. HOWEVER, this is only half the story. It is also necessary to have the conditions removed (I-829 petition) plus most investors are hoping for the return of their investment after a finite number of years. The implications of this require detailed explanation on the implications of past performance.

 Escape the bad weather
Today’s blog is coming to you from London’s freezing cold Gatwick airport as I try to return to the USA after having to postpone last week’s return due to flight cancellations caused by the snow.
It’s been a busy time over the past few weeks; I have been discussing the various regional center programs with many families in Europe who are planning immigration to the USA and are considering the EB5 visa as a preferred option. For many the reason is that the program offers permanent residence for the applicant as well as their spouse and children under 21.
It is interesting that many of those I speak to raise similar issues of concern regarding the EB-5 program, such as; what is the success rate of the various programs? Has anyone got their $500,000 back? What have I found behind the scenes when I have visited various regional centers? Which programs seem to have suffered delays?

One of the most important questions a family can ask to enable them to make an informed choice of program is very rarely asked. The question is fundamental to maintaining permanent residence after 2 years and can be an indicator to the return of your $500,000 investment.

In an attempt to determine which is the most appropriate regional center program some families carry out due diligence with statistics.
The problem with statistics is they display data any way the supplying companies want. Are the centers with the highest number of approvals the best choice for you?
Statistics may give you the figures, they will not give you all the conclusions to draw from them.
For example, the statistics will not tell you:
• If the I-526 and/or I-829 approvals were for a particular project and the center now operates a different type of program.
• They will not tell you if USCIS has changed its perspective on the program for that regional center.
• The statistics will not tell you the likelihood or otherwise of investors getting their capital investment back from that center.
• They will not tell you the implications of most of the applicants coming from a particular country.

These type of programs focus on your $500,000 investment (in an approved regional center program) being used as part of a fixed term loan to a company, business or economic development agency, rather than being used as a direct investment in a specific building, resort or enterprise.
This type of program is becoming increasingly popular as many potential EB-5 visa investors are focusing on three issues:-
• Obtaining their green cards in a timely manner
• Having conditions removed after two years
• Maximizing the likelihood of the return of their $500,000
Effectively, rather than investing in programs such as commercial real estate, resorts and mixed fund investments which may not have a clear specific and dated exit strategy, an alternative is to invest in a regional center program which loans the funds to an infrastructure development project, such as developing roads, sewerage systems etc. The loan has a specific time period usually five or six years.

A number of people that considered applying for the Canadian immigrant investor visa program had not realized that the USA has operated a similar program.
The Canadian program requires a $400,000 Canadian Dollar investment for a five year period as a no interest loan to the government. The U.S. EB5 program requires a $500,000 US dollar investment in a wide range of government approved regional centers.
