What do I do if I cannot obtain labor certification?

Foreign national are finding themselves increasingly affected by Department of Labor regulations requiring employers to pay labor certification fees and costs. An increasing number of employers cannot or will not pay legal fees and advertising costs for a labor certification application on behalf of a foreign national employee. EB-5 Investment

We are often approached by journals, magazines and newspapers asking for our views on the EB-5 regional center program from a consumer perspective and the implications of so many regional centers being approved by USCIS to offer the program.

Increasing choice has to be generally seen as a good thing however we do have a number of reservations given that from the immigrant investors perspective so much hangs on selecting the most appropriate center.

Many investors are looking to three fairly obvious and basic requirements – they want to be successful in obtaining the visa, they want conditions removed after twenty one to twenty four months and they would like their investment to perform well and at least get the $500,000 back in a reasonable time.

USA EB-5 Green Card or Canadian Investment Visa?

A number of people that considered applying for the Canadian immigrant investor visa program had not realized that the USA has operated a similar program.

The Canadian program requires a $400,000 Canadian Dollar investment for a five year period as a no interest loan to the government. The U.S. EB5 program requires a $500,000 US dollar investment in a wide range of government approved regional centers.

When comparing regional centers for an EB-5 visa how much research is enough research?

The situation is understandable. You are looking into the various regional center investment options for the EB-5 program and are spending days, week’s maybe even months searching the Internet in an attempt to find information on the relative advantages, or just as importantly, disadvantages of the ever growing number of regional centers.

A number of the most experienced EB-5 attorney firms do not provide comparative information on regional centers.  Instead they focus on the legal aspects of immigration using the EB-5 visa.

So, you continue to search for useful information; such as how many successful applicants has each center processed? However, how helpful is that statistic? EB5 - the fastest route to permanent green card?

At the Senate Judiciary Committee.hearing last month, Robert Kruszka, deputy chief of service center operations at the Department of Homeland Security’s Citizenship and Immigration Services, said that approximately $ 1 billion has been invested in the U.S. economy through the EB-5 immigrant investor program since Oct. 1, 2006.

Kruszka added that several steps have been taken to improve the EB-5 program.

A year ago it took USCIS an average of 14 months to process a regional center proposal, the processing now takes about four months, Kruszka said. The average processing time for an individual EB-5 visa petition previously took seven months, but now takes about four months, he said.

EB-5 visa discussions at 36,000 feet

I have just enjoyed another nine hour flight across the Atlantic after undertaking several relocation briefings in Europe. It seems that whatever the troubles are in the world there are still many of you who for a number of reasons want to emigrate to the USA, however sometimes that’s where problems can start.

On the flight over I was talking to the passenger next to me, who hearing what I do relayed his experiences of the immigration process, some of his problems seemed more turbulent than the bumpy patches we kept hitting during the flight!

He had embarked on the treadmill of immigration to the States several years before beginning with an investment of over $300,000 in a business to obtain an  L1 visa which had been granted for one year. However he had found it difficult to maintain his business in his home country while developing his new business in America; he had been advised by his Attorney to then apply for an E2 visa. This was successful and he was granted a visa for three years however the full implications of the E2 visa not providing permanent residence had not registered with him.

As we were talking he mentioned that his eldest child was just finishing High School and about to enter University in the States, he had found out that she would not qualify for lower fees that residence status would have provided and additionally she may well have to return to her country of birth after graduation, as after 21 she would no longer be covered by his E2 status.

Apparently he had never been advised about the EB-5 program or the financial implications of not having permanent residence status - when adding up all his costs to date comprising several sets of attorney fees, the business investment in the USA, higher property taxes, higher College fees for his children and after all that the children having to return to their country of birth, it seemed an expensive oversight.
