Your EB-5 timeline

It goes without saying, but your personal timeline is entirely individual.  Each investor and his or her family have ideas about what they would like their own personal timeline to look like.  You have some idea of a target date or estimated date when you would like to be living stateside.  You will have many factors that come into play with this that will affect your personal timeline.  We will discuss these at length in future blog entries.

Formulating your personal timeline will be quite tricky, and this is where once again the guidance of an experienced EB-5 advisor and your immigration attorney will prove invaluable.  They, working together, will help you marry your goals and needs with the reality of the process and capabilities of processing within the constraints set by outside factors; namely the regional center you choose to invest in and the USCIS, at the mercy of which all involved place themselves.

Even though you cannot control these outside factors, you can minimize their impact by being prepared to attend to them in an efficient and effective manner.  When you know what needs to be done and when, you can come to each task well-prepared, and streamline your personal process.  That is the greatest advantage that both the information in this blog and the knowledge and assistance that your team of advisors can give to you.  Together with your EB-5 advisor and this knowledge, you will be ready to construct a reasonable personal timeline and regain an element of control in a period of your life that leaves many less prepared immigrants feeling as if theirs has spun out of control.

Basic timeline of an EB-5 regional center investment

No discussion of timelines for EB-5 investing is complete without at least introducing the basic timeline for investing from the regional center perspective, since that is in truth a part of the whole process as well, and it is the very beginning of the active phase of the immigration through investment process.  USCIS’s procedures and processing times determine most of the timeline in this process; however, you should not underestimate the impact of the regional center and its timelines and procedures on your personal timeline.

The timeline for investing from start to finish can be lengthy in some cases, and will definitely need to be factored into the overall timeframe.  In fact, the proposed timeline for a center and their track record for abiding by it may be one of those considerations that you and your EB-5 consultant weigh when looking at your choice of regional center.

Each regional center will have its own set of pre-determined procedures, and hence also their own individual timeline that is specific to their center and their project.  Due to this fact, no one can outline the procedures and timelines of all of the more than 40 regional centers for you, but we can illustrate, for the sake of education and information and planning, what a basic regional center timeline and process will look like.

Timelines for the EB-5 investment (ll)

When considering the time lines for the EB-5 investment, you need to consider a few time lines that all need to be coordinated and work in conjunction with one another.  Those are:

•    Your own personal timeline based upon your and your family’s goals and plans for relocation (we will discuss this further in later blogs).  You should discuss this time frame with your regional center selection advisor and with your immigration attorney, so that you can plan realistically, and then set and reach your goals as promptly as possible.

•    The timeline for searching for the right regional center for you, for conducting due diligence to make sure that it is right for you, for registering with the regional center and investing, and for filing your I-526 petition with USCIS.  Once again, your EB-5 advisor/consultant and immigration attorney can prove invaluable in guiding you through these processes and setting a realistic time lines for their completion.  They are familiar with the amount of time that it will take to gather the information from the regional center, to work with the business attorney, CPA, and possibly other business consultant assisting you in the due diligence phase prior to your investment.  Once you will have made your investment, then the work is primarily in the hands of your immigration attorney, and so then it will then come down to his or her time frame for processing your case.

•    The time line for USCIS to process your I-526 petition, and then for USCIS also to process your adjustment of status or for the State Department to process your application for an immigrant visa, is beyond your and everyone else’s control; however, your immigration attorney can advise you of what the current processing time is, and can help you to avoid needless delays due to inadequate documentation or other problems.

Not all of these time lines are set in stone, and so while we can provide you with some idea of what you are looking at in terms of timing and planning, no one can guarantee them—these are all beyond any of our control in that regard.  What we can do is present you with a comprehensive understanding of the tasks ahead of you and the relative timeline on which you can base your plans.  This will prove extremely beneficial as you begin to take action, investing and applying for your permanent resident status.

Knowing how the process should go and being prepared to meet the requirements and challenges at every step of the way will make your immigration process go as smoothly as possible, and give you the best preparation for a relatively speedy and successful application.

EB-5 Timelines & Procedures

Now that you have a grasp on the elements involved in immigrating under the EB-5 immigrant investor program, it is time to find out just what actions you need to take.  In this next series of blogs we will go over the complete timeline for immigration through investment, from start to finish.  We will also discuss the professionals with whom it is advisable to work in preparing and carrying out your plans to immigrate under the EB-5 program. As you will come to learn, this is not only a timeline of application procedures for the USCIS; the time lines and procedures start well before that point with the process of investing in an EB-5 project.

Professionals to work with in preparation and realization of your immigration plans

Given that there are now over 40+ regional centers, it is important to work with experienced advisors, who can help you to evaluate the strengths and weaknesses of the various regional centers in order to determine which one best enables you to succeed in the immigration process as well as best safeguards your investment.  From your perspective, plan on working with your EB-5 advisor/consultant and a carefully selected immigration attorney, who is experienced in working with the EB-5 program.

You should also work with your EB-5 advisor/consultant, who can give you an overview of the different regional centers from the perspective of the mechanics of how each specific program functions in terms of program requirements, give you the time frames for how long the money must be invested, explain the exit strategy once the immigration requirements are fulfilled, explain how the underlying business works in the project that the regional center is offering, and share feedback from investors in different regional centers.
