Will the EB5 visa pilot program be renewed?

There has been concern that the EB5 regional centre visa pilot program is due to end on March 6th 2009. For many considering permanent residence and work or retirement in the USA the $500,000 investment in an approved regional centre has been the only realistic option open to them.

The latest news is that it does look as though there is the possibility that a six month extension for the EB5 visa may be incorporated into a continuation bill, which covers the temporary financing of government. However, we believe that a further five year extension is not clear as both the President and Congress may review the entire process and it has become apparent that the new administration may well have a number of other priorities.

Obtaining the latest information on the future of the EB5 may be critical to your timing for a move.  To obtain the latest information on what is happening in Congress, particularly if you are planning a move or considering the EB5 route, its worth getting an update on the progress of the EB-5 extention.

Looking beyond the immediate dangers of immigration to the USA

The following article on America  recently appeared in Emigrate Magazine regarding cases of investigations into alleged theft of funds from potential immigrants. The problem is this article is only part of the story and certain important elements are missing which are of key relevance if you are considering immigration to the USA. We have carried out hundreds of briefings over the years to immigrants who have been at best misled and at times conned out of their savings; their dreams and whose lives have been ruined by the actions of others. The immigration process to the States seems to have had its share of misleading information and and a recent case of fraud. Following our regular due diligence checks we have come across a number of problems.  A number of claims are being made from certain regional centers as well as from some visa consultants that need to be looked into. Recent examples of extremely dubious claims that require further elaboration include ‘eb5 visa in 6 months’, ‘only government approved regional centre’ - there are key reasons why these statements require further research before taking them as read. Why do some immigrants have to leave the USA?

We seem to be working with increasing numbers of clients who have lived in various states of the USA for a number of years, who immigrated to the USA on E2 and L1 visas, lived happily in their chosen State and watched their children go to school and grow up knowing only the American life. Application and Timing

The total time from application to approval takes approximately nine to fifteen months and at the time of writing every EB5 regional centre investor in certain programs has received a CONDITIONAL green card, however some programs have encountered specific difficulties which are not being flagged up on the web. (Under the regulations, an investor who is approved for the EB-5 immigrant visa receives a “conditional” green card, which must be reissued after two years. Otherwise, the two cards offer the same rights and privileges).
