Real Life Stories of EB-5 Immigrants
An Argentinean family, father (in the legal profession), mother and their children had spent several months looking at their options for immigration to the USA. Time was a key factor as they wanted their children to be able to start school at the beginning of the school year in August. Like a number of families in the current world economic climate they placed emphasis on a regional center with a fixed term exit strategy, and a reliable policy to create the necessary ten jobs, rather than an unknown and potentially unspecified exit strategy. From the time of the filing of their application to the successful approval of their I-526 took three months and the family achieved their timetable objectives to relocate in the USA.

Australian family move to USA on the EB-5 visa
This family owned a large business in Australia and the UK. They required a visa that offered permanent residency and green cards for the whole family as they had older teenage children they were concerned that otherwise there was too much risk for their future. They decided to invest $500,000 in a Limited Partnership under a Regional Center in a Targeted Employment area. The Project involved the demolition, renovation and construction of a warehouse/storage complex for mixed use. Upon completion of the construction the new structure housed tenants and created 10 direct/indirect jobs for each of the Investors in the project The I-526 approval took several months and the couple were then interviewed at the U.S. Consulate and granted visas. The family have now had their conditions removed (I-829 stage) and are considering US citizenship.

Família brasileira muda para os EUA Brazilian family relocates to the USA
A Brazilian entrepreneur had discussed the concept of the EB-5 visa with a number of Attorneys but was concerned that they did not appear to have an in-depth knowledge of proven regional center projects and importantly, in his view, had not made visits to a significant number of the actual regional center facilities. He felt it important that the program of choice had a 100% success record, would repay the investment by a specified date and was involved with State or regional center projects rather than involvement exclusively in the private sector.

British family retires to Florida following sale of software business.
This British family (father, mother and three children) wanted to relocate to America, but did not want to be involved in the day to day operation of a business. They felt that after building up a successful software business in the UK and then selling it, they wanted to focus on enjoying life with their children and wished to settle in New York. They did not wish to spend too long researching the various EB-5 programs, feeling that to carry out the necessary analysis of over eighty centers was just not viable and after reading our book Green Card via the Red Carpet, were particularly interested in the information we accumulated when visiting the various centers. The family received their I-526 approval approximately three months after filing.

British National Invests $525,000 in a downtown hotel
A British couple, who had spent many happy holidays with their children in Orlando Florida over the past twenty years, had been looking at ways they might be able to retire permanently in the U.S. but were concerned that their only options apparently related to the E2 and L1 visas (which do not allow or guarantee permanent residence). They were also concerned that the attorneys they spoke with, focused only on the legal aspects but were not really listening to their personal requirements, including their wide ranging concerns on their retirement in America. I-526 approval took several months and the couple were then interviewed at the U.S. Consulate in London and granted immigrant visas. The couple have subsequently had their I-829 removal of conditions granted and have settled very happily in the Florida way of life playing a lot of tennis and golf and making friends has as they say “made them more active and busier than they were in the UK “.

Successful Canadian Businessman takes fastest route to USA
A Canadian businessman’s main priority when looking at relocation to the USA via the EB-5 visa was selecting a regional center to obtain a green card as fast as possible then to recover the initial capital invested as quickly as possible. A return on the investment was felt to be a bonus but not a priority. The businessman initially expressed a preference for a center with a simple business plan that invests in a tangible asset as opposed to providing business loans. He had some concerns regarding a few of the asset based programs compared to loan ones given their potential vulnerability at I-829 stage in relation to job creation, poor returns from the initial programs (i.e. less than the initial investment), and ambiguous exit strategies. The actual process from investment to approval took just under four months and he has now resettled in the USA and remains pleased with his choice.

Chinese EB-5 visa applicant successfully chooses secure and proven regional center program
This gentleman was looking at visa options that would provide him with permanent residence in America. When he came to us he had been provided with information from a number of immigration agencies in China. He was concerned regarding some of the programs they had sent him which he felt were relatively unproven and had a higher than acceptable number of risks. The gentleman narrowed down to a shortlist of two and following a report from his independent accountants (shown below) opted for one particular program. “From what we see, it looks like X is a reputable company and judging by the letters attached from Government Agencies, they are in compliance with regulations and have been approved for this project. A rating of AAA is the best you can get. It signifies financial strength of the backers of the bonds. You can verify the AAA rating on Moodys and Standard & Poors' website.” “While no investment is 100% safe, this appears to be a legitimately federally sponsored project with the usual investment risks associated with them. We read where even this risk is mitigated according to what X has stated. As you know, $500,000 is the minimum amount that can be invested and it appears that it is a short cut to you getting a Green Card once the job creation requirement is met.” The Gentleman successfully applied for permanent residence via the EB-5 regional center visa selecting the proven center above and using the specialized immigration attorney we had recommended.

Chinese EB-5 visa applicant faces traps
This gentleman contacted us as he was concerned about the potential dangers of taking advice from agents in China who had not visited and thoroughly researched the various regional center programs. As he said, “some seemed more motivated by obtaining the highest level of commission from the regional centers than concentrating on my long term interests”. Mr. Li (not his real name as he required anonymity) wished for his wife and children to live permanently in the USA while he operated his business interests in China, therefore a US based aftercare service assisting his family was of importance. He also required on site assistance regarding the formal US interview presence in China and total discretion regarding his family’s financial interests. Given these concerns we introduced Mr. Li to a leading and discrete Chinese born and educated EB-5 immigration Attorney who qualified and practices in the USA and could cover all issues with him in both English and Chinese. Through the Attorney we discussed with Mr. Li the positives and negatives of the various programs all of which we had researched and visited. Mr. Li decided to visit two of the centers on his shortlist and subsequently successfully applied for one of the very few proven centers with a 100% record and a fixed term period for the investment. The process took seven months and Mr. Li’s family now live in California while he continues to maintain his business interests in China.

Citizens of some countries maybe more vulnerable than others when not obtaining impartial, independent advice or working with a consultant who also advises regional centers. A recent article in the Chinese press highlights the dangers for Chinese citizens, trying to immigrate to the USA. An article in ‘China Daily’ warns that "Chinese investors may be victimized by financial traps set up by Chinese immigration agencies and foreign investment organizations". There have apparently been complaints regarding the handling of EB-5 immigration cases in China, an example given is Mrs. Zhang in Beijing who found herself charged a brokerage fee by the agency she was using that was far in excess of the figure originally quoted.
Dubai businessman obtains permanent residence in the USA
A businessman from Dubai had been looking into the various options to relocate his family to the USA for several years. However, until the EB-5 had become a proven alternative he had not identified a visa that he felt met his purpose. We had a number of detailed discussions with him regarding the various programs as well as other issues and in particular the education system in different parts of the USA. Following further consultations with us the gentleman identified both a program that he felt best matched his requirements and an Attorney who he felt confident with.

Successful Green Cards for Indian family.
This gentleman had undertaken some research, mainly on the web, and had identified a number of programs that he felt could be of interest. He had also contacted an immigration agency in India but had concerns as he felt they did not have the in-depth knowledge he required of the centers and had not even visited the centers. Although initially his priority was to identify a center with a high rate of return following further discussions and research he discovered that these tended to have somewhat ambiguous exit strategies, meaning his $500,000 investment could be tied up for an unspecified and potentially lengthy time period. The process from the filing of his application to the approval of the I-526 was just over three months.

Successful EB-5 Green Card for Indian applicant on H1-B visa who faced leaving USA after ten years
The gentleman had relocated to the USA from India several years ago. After working in the USA for a number of years and renewing the H1-B visa he faced a problem with the waiting time required for a further renewal of the H1-B. This, despite both his desire to remain in his job and his companies willingness to help him, could have necessitated his departure from the USA. After a discussion with Stephen Parnell he looked at the EB-5 regional center pilot program in more detail. Project track record, speed of obtaining the green card and investment with a company that offered a specific exit strategy were important criteria for him. He decided to invest $500,000 in a well established center that had an existing program loaning development funds over five years for the expansion of a major state/city conference centre –he was less concerned about the modest interest rate on the loan as his focus was on minimizing risks regarding the return of funds. The I-526 approval took just over three months and the applicant received his green card a little more than a month later – the process taking a total of just over four months. We have continued to keep in touch and checked out issues that have come up with him for the benefit of new investors.

Indonesian businessman thoroughly researches EB-5 program.
An Indonesian citizen was seeking detailed guidance on the various EB-5 programs available. He was specifically looking for a clear exit strategy with a time deadline for return of his investment, an ongoing and proven project that was as low a risk as possible and an experienced immigration attorney independent of the regional centers with an excellent track record of handling EB-5 cases. The gentleman had very specific questions on a number of regional center programs he had researched, he was particularly interested in the reality of the claims they were making. We briefed him on the information we had on these centers following our visits to the centers. We explained which programs met the criteria he had laid out. We also put him in touch with a leading experienced immigration attorney specializing in the EB-5 visa. The actual time span between the filing of his application and the granting of I -526 approval was three months.

Irish family relocate to Florida on the EB-5 visa
An Irish family who had significant agricultural holdings had been monitoring the progress of the EB-5 visa for several years. They had originally purchased property on the east coast of Florida and taken lengthy holidays to see how they would adjust to the American way of life. They then purchased other properties for rental, taking advantage of the bottoming of the property market and to build an earnings portfolio for eventual relocation. They required a visa route that offered permanent residency and green cards for all the family, and wished to increase their property portfolio once they had resettled in Florida. After a detailed briefing with us they decided the EB5 pilot program was the most appropriate option and looked into the various programs in more detail. They emphasized that they required a program which had not suffered from long delays caused by requests for further evidence (RFE’s), they were also concerned that the program had been operating for several years, complied with job requirements and had a clear and specific exit strategy. After investigating the alternatives and narrowing them down to two options they opted for a project which to date has a 100% track record of approval. Following clarification on a number of issues they invested $500,000 – there where additional administration and attorney fees. The family required an Attorney based in Florida with a track record of working on EB-5 applications and also had a number of questions for us regarding possible locations to resettle in, the schooling system, removals, property, transfer of pets, health coverage etc. The I-526 approval took three months and the couple were then interviewed at the U.S. Consulate and granted visas.

Jamaican national obtains permanent residence on EB-5 visa
The family who had been looking for the best way to achieve permanent residency in America, decided to use all the facilities of WhichEB5 to thoroughly research all the various proven EB-5 programs. They wished to look in-depth across a range of programs in particular the likelihood of the necessary jobs being created in time to ensure the removal of conditions at I-829 stage. We identified for the family that although some centers seemed to indicate their affiliation with State Government, this was giving a misleading impression in relation to the guarantee or otherwise of the actual return of the investment. We had a long video consult as a first step then met with them for a detailed face to face follow-up.

Mexican national chooses a different regional center project on examining the facts.
A citizen of Mexico sought our guidance on the various EB-5 programs after finding out about the EB-5 visa through seeing advertising material for one of the longer established programs. In initial discussions with him it became apparent that although he had been given all the positive facts on this particular program, such as a monthly return on his investment, he had not been made aware of any of the downsides. After becoming aware of the restrictions of focusing only on the advertised returns of the program, particularly if the necessary number of jobs failed to be created; the gentleman decided to look more into the needs for a clear exit strategy to maximize the chances of getting his $500,000 back. We went through the advantages and disadvantages of various programs and following a visit to his shortlisted option the gentleman successfully applied for the EB-5 visa using a program with a clear and specific exit strategy. We have continued to keep in touch and checked out issues that have cropped up with them for the benefit of new investors.

After going through the options he opted for a well established center with a wide range of diverse developments. Financial Consultant from Pakistan in the USA on an H1-B visa
The gentleman and his wife had relocated to the USA from Pakistan nine years ago. Initially he came over as a student on an F1 visa and after graduation worked for a major financial sector company in New York. After working for six years on an H1-B visa, he faced a problem with the uncertainty and waiting time required for labor certification cases and adjustment of status. All this despite both his desire to remain in his job and his employers willingness to help him, could have meant he would have to leave his home in the USA and return to Pakistan. After a meeting with Stephen Parnell in New York, and discussions with an experienced EB-5 attorney, he looked at the EB-5 regional center pilot program in more detail and specified project track record, speed of obtaining the green card and investment with a company that offered a specific exit strategy as important criteria for him. He decided to invest $500,000 in a limited partnership project in an approved and proven regional center program for the development of a project in California. Approval took a little less than three months and the applicant received his green card a month later.

South African family relocate to the USA
The family had spent some considerable time investigating options for immigration to different countries with their short list comprising Australia, Canada and the United States. They had concerns regarding the climate being too cold for much of the year in Canada and felt Australia was less central for their business requirements than the USA, deciding that California was the best match for their needs. Once they had determined that California most suited them they had spoken to an Attorney regarding visa options and she had put them in touch with WhichEB5 to take them through the various regional center programs. The family was particularly concerned that once they received the visa there should be no problems at the two year stage (the removal of conditions) so were very insistent that the center should have a proven and straightforward record of job creation. They also did not want a project that could have difficulty obtaining subscribers, in case it did not reach a critical mass and then failed to go ahead. Finally exit strategy and the return of their funds was an important consideration. These specific requirements considerably narrowed down the range of options and after discussing these with them over a number of internet phone conversations, a meeting was held at our office and subsequently they visited three regional centers. Their final decision was based on these visits with the chosen center particularly impressing them, as they felt as an ongoing program it was well proven and minimized as far as possible risk factors. The family has now successfully relocated to California. We have continued to keep in touch and checked out issues that have cropped up with him for the benefit of new investors.

Although the EB-5 regional center program had been very popular with South Korean citizens immigrating to the USA there have been concerns. These concerns were following reports of litigation involving Korean families, who had several years previously taken the EB-5 visa route and subsequently discovered legal issues relating to the particular program they had invested their $500,000 capital with. A South Korean family wishing to relocate to the USA had therefore contacted WhichEB5 for guidance on the latest position regarding the various regional center programs, as they wanted to be informed of the negative details as well as the positive details of the various programs, so that they were aware of the issues that had clearly caused difficulties for the families above. The family wanted to identify regional centers that had not only a reliable and long term track record but had also repaid previous clients funds in full i.e. returned the full $500,000 investment following the granting of the I-526 approval and the removal of conditions at the I-829 stage. A company was identified that met all these criteria and the family successfully applied for a place on their program.
